Article 12 allows for the employer to excess, (forced transfer), employees into another craft or
installation into a withheld assignment. Management has informed the NALC that they are
excessing clerks into other crafts. Once all clerk vacancies in the installation have been filled,
the pecking order is:


     1. Other crafts in the same installation
     2. Clerk craft different installation
     3. Other crafts different installation


The clerk would come into the craft as the junior regular. As per Article 41 section 2 their
seniority date would be the day they start in the craft.


The employer can excess an employee to the same or lower pay level. A clerk could not get
placed into a withheld T6 string since they do not meet the qualifications. To be a T6 you have
to have a high school diploma and 1 year as a carrier or 2 years as a carrier.


The postal service notified the NALC that they were withholding assignments to excess in a 500
mile radius. Article 12 states that they are to minimize the disruption to the employee.


The clerk being excessed has the right to revert to PTF status and stay in their home office
instead of being excessed. A senior clerk would have the right to volunteer to be excessed,
instead of the junior employee, if they wanted to transfer to the gaining installation.


The excessed employee has retreat rights.


     • If they are excessed to a position in their same installation they must go back to the clerk
       craft at the first available full-time clerk vacancy.
     • If they are excessed outside their installation when a full-time vacancy in the clerk craft of
       their original installation occurs they have a choice to go back. It is a one time choice. If
       they choose not to go back they are not given any other offers.


The NBA office will be tracking the comparative work hours after the excessing to insure that
management complies with the National Agreement. Therefore, it is necessary that you report all
clerks excessed into your office immediately. We need to report their names, work location
excess from and date they came into our craft. If the agreement was not complied with the
NALC will assist those clerks in returning to their craft.
